Tender Description
This tender is for:
(a) Electrical Maintenance works on Council owned assets;
(b) Electrical Project Work on Council owned and Endeavour Energy assets; and
(c) Electrical Design Work on Endeavour Energy assets.
With respect to this RFT the Services will be divided into the following categories:
(a) Scheduled Maintenance
(i) Scheduled Maintenance covers the work and services identified as Scheduled Maintenance in the Scope of Services.
(ii) To be undertaken by the preferred main contractor chosen by the Council through the tender process (Main Contractor). The Main Contractor will be engaged for a 3 year term (with two one year options at Council’s absolute and sole discretion) under an amended AS4920-2003 contract (Main Services Contract).
(iii) This work will be undertaken under a pre-agreed fixed pricing structure for the particular pre-agreed scopes of work (with the prices required to be fixed lump sum and cover all aspects of the work required including the provision of materials to undertake the work). The pricing will be fixed but subject to annual CPI adjustment.
(iv) The Main Services Contract will include within it an option for Council, in its absolute and sole discretion, to remove some of the Scheduled Maintenance from the Main Services Contract so that this work can be undertaken by Council’s internal team or other contractors.
(v) The quantity of work is not guaranteed and may change in Council’s absolute and sole discretion.
(b) Reactive Maintenance
(i) Reactive Maintenance covers the work and services identified as Reactive Maintenance in the Scope of Services up to and including $50,000 inclusive of GST.
(ii) To be undertaken by the preferred Main Contractor in accordance with the Main Services Contract.
(iii) This work and its quantity is not guaranteed, but it is anticipated that work of this type may be required during the Term.
(iv) If such work is required, then the Main Contractor will go to site, review the issue and either make safe and fix the issue or make safe and report back as to the issue. If the Main Contractor is able to fix the issue at that time then it is to undertake this work in line with a pre-agreed schedule of rates (to cover labour rates for estimated hours of standard expected work (based on prior benchmarks) /call out fees/cost of goods and margin on goods).
(v) Any goods used and claimed for by the Main Contractor are to be claimed on an open book basis with evidence provided of the use of such goods. The schedule of rates will be fixed but (other than the margin which will remain unchanged) subject to annual CPI adjustment.
(vi) The intent of this work is for the Main Contractor to initially make safe the issue and, if the work required will be less than or equal to $50,000 inclusive of GST, undertake the work to correct the issue. If the work will exceed the threshold, then it will be tendered as Corrective Maintenance or major project work – depending on the value/complexity of the issue.
(c) Corrective Maintenance
(i) Corrective Maintenance covers the work and services identified as Corrective Maintenance in the Scope of Services up to and including $50,000 inclusive of GST
(ii) To be undertaken by the preferred Main Contractor in accordance with the Main Services Contract.
(iii) To be undertaken by the Main Contractor in accordance with the Main Services Contract.
(iv) This type of work is usually identified when completing the schedule maintenance work and is intended to repair and fix an asset back to the intended design and service level before the asset fails to perform.
(d) Project Work
(i) As part of this tender process, tenderers will also be given the opportunity to tender for Corrective Maintenance and Project Work.
(ii) Project Work includes:
(i) Reactive Maintenance work over $50,000 inclusive of GST
(ii) Corrective Maintenance work over $50,000 inclusive of GST
(iii) Electrical Project Work on Council owned and Endeavour Energy assets which the Council in its absolute and sole discretion requires to be undertaken; and
(iv) electrical design work on Endeavour Energy assets which the Council in its absolute and sole discretion requires to be undertaken.
(iii) Council in its absolute and sole discretion will establish a panel of tenderers for this work based on the tenderers who tender for the Scheduled Maintenance and Reactive Maintenance and who complied with the Tender requirements for Corrective Maintenance.
(iv) The Project Work including Reactive and Corrective Works over $50,000 including GST will be open to Council’s chosen panel of tenderers (which may include the Main Contractor).
(v) This work will be quoted by the tenderers on a lump sum basis in accordance with a Standing Order Umbrella Arrangement that will be pre-agreed and entered into with each of the tenderers selected by the Council to – again utilising an amended AS4920 as the base set of terms upon which the tenderer will be engaged for specific projects.
(vi) The term of the Standing Order Umbrella Arrangement will also be 3 years (with two one year options at Council’s absolute and sole discretion).
(vii) If a tenderer’s quote is accepted, then a work order will be issued in accordance with the Standing Order Umbrella Arrangement and a separate work order agreement will be entered into between Council and the tenderer for the specific work.
(viii) This work and its quantity is not guaranteed but will be subject to Council determining what work is required and when it is to be undertaken.
Subject to the terms of the Main Services Contract, the Main Contractor will receive all the Scheduled Maintenance. In addition, the Main Contractor, subject to the terms of the Main Services Contract, will receive first preference for all Reactive Maintenance.
The applicable terms and conditions of engagement for Scheduled Maintenance and Reactive Maintenance are detailed in Attachment 6 – Main Services Contract.
The applicable terms and conditions of engagement for Corrective Maintenance and Project Work are detailed in Attachment 7 – Umbrella Deed.
A more detailed brief of the extent of work and services required by Council is set out in Attachment 3 of this RFT – Scope of Services.
In this RFT “Contract” means, as applicable, the Main Services Contract or the Umbrella Deed.
