Tender Description
CSIRO, through this RFQ, seeks to contract one or more electricity retailers (Suppliers) for grid-fed electricity for CSIRO sites in the following Regions:
a.Australian Capital Territory (ACT)
b.New South Wales (NSW)
c.Queensland (QLD)
d.South Australia (SA)
e.Tasmania (TAS)
f.Victoria (VIC)
g.Western Australia (WA)
Conditions for Participation:
5.1.1Subject to clause 5.7, Unintentional Errors of Form, CSIRO will exclude a Respondent from further consideration and evaluation if CSIRO considers in its absolute discretion that the conditions for participation set out in this clause have not been met by the Respondent. Notwithstanding anything else contained in this RFQ, only requirements listed in this clause will be deemed conditions for participation.
a.the Respondent exists as a legal entity at the RFQ Closing Time and Date
b.at the RFQ Closing Time and Date, the Respondent must not have been:
i.precluded from tendering for Australian Government funded work or
ii.subject to a judicial decision against them relating to employee entitlements (not including decisions under appeal, and have not paid the claim)
c.on or before the Phase 2 Submission Time and Date set out in clause 5.3.1, or a time and date otherwise notified by CSIRO, the Respondent:
i.holds a Valid and Satisfactory Statement of Tax Record, and
ii.holds a Valid and Satisfactory Statement of Tax Record for any First Tier Subcontractor that it proposes, as part of its response, to engage to deliver goods or services with an estimated value of over $4 million (GST inclusive).
d.the Respondent must comply with all Mandatory Requirements identified in the Attachment A.
5.1.2The Statement of Tax Records requirements at clause 5.1.1c also applies to new businesses or foreign businesses that do not have an Australian tax record of at least four years. Further information can be found at clause 2.1.1 under Black Economy Procurement Connected Policy.
5.1.3Where applicable, Respondents should apply for a Statement of Tax Record and should ensure that their subcontractors apply for a Statement of Tax Record within sufficient time to meet these conditions for participation.
