Tender Description

The Territory is seeking to engage a suitably qualified organisation to undertake the role of Independent Certifier for the Material Recovery Facility Project.

The key objectives of the project are:

• Safely demolish the existing Materials Recovery Facility and remediate the site ahead of construction of the MRF.

• Provide critical recyclable processing infrastructure to enhance recycling and implement glass fines processing under the recommendations within the ACT Waste Feasibility Study’

• Divert recoverable waste from landfill and reduce greenhouse gas emissions’

• Recover recyclables to create products that may be sold on for further use, and thereby strengthen the Territory’s circular economy’

• Support key Territory and Federal Government resource recovery and landfill diversion targets including:

  • The ACT Waste Management Strategy 2011-25 target of increasing the rate of resource recovery to over 90% by 2025, with no recoverable waste sent to landfill,
  • Develop markets for recyclable materials and strengthening regional connections.

Statement of Requirements

At a minimum, in providing the Services, the IC must:

• The IC must perform all of the functions, tasks and obligations of the "Independent Certifier" as set out in the MRF Contract, including but not limited to the functions, tasks and obligations contained in the following clauses of the MRF Contract :

1. clause 24.9.2 – determining whether it is probable that the Contractor will achieve all relevant Events by the relevant Sunset Dates or whether it is probable that the Contractor will achieve all relevant Events by the relevant Sunset Dates by taking measures to accelerate the Delivery Activities; accelerate the Delivery Activities;

2. clause 25.2 to 25.3 – inspecting the Facility to determine a punch list and/or determine whether the Delivery Activities are too incomplete for the Independent Certifier to provide a punch list for Construction Completion;

3. clauses 25.4 to 25.5 - inspecting the Facility and issuing a relevant notice in respect of the achievement of, or failure to achieve, Construction Completion for the Facility Works;

4. clause 26.1 – reviewing and commenting on the Commissioning Plan;

5. clause 26.2 – determining whether the Commissioning Assessment has been successfully carried out for the purpose of determining Operation Readiness;

6. clause 27.2 – determining whether the requirements for Operation Readiness have been satisfied and issuing the Certificate of Operation identifying the date on which Operation Readiness was achieved;

7. clause 24.4 – determining a Dispute between the parties regarding the Contractor’s entitlement to an extension of time under this Agreement; and

8. reviewing and commenting on Delivery Management Plans in accordance with Schedule 6.

• attend meetings and report as required from time to time by the parties;

• otherwise discharge the functions of the Independent Certifier under the MRF Contract.

Detailed requirements and responsibilities under the MRF Contract will be provided at the second stage of this procurement process.
