Council is seeking expression of interest from suitably qualified companies or individuals to undertake in consultation with Council Staff the initial catergorisation of Community Land in conjunction with preparing Plans of Management (PoM) following the requirements of Section 3.23 of the Crown Land Management Act 2016 (CLMA) and the Local Government Act 1993, for all Crown reserves classified as community.
Plans of management (PoM) set out objectives and performance targets for community land and provide for active land management and use, including the issuing of tenures over the land. PoMs for Crown reserves typically provide a wealth of information about that site, including social, environmental and economic values.
As part of the brief it is expected that the successful consultant will analyse and review the Office of Local Government guidelines and the NSW Government guidelines for Developing plans of management for community land Crown reserves, as well as the forms and templates to assist with the preparation of a PoM. The following are the base requirements for preparing the Crown Land Reserve PoM:
- Investigate reserves and determine generic or specific plan
- Review Councils initial categorisation of reserves and confirm to Council if any amendments are required. This will enable Council to lodge the initial categorisation to the Department
- Undertake site inspections
- Consult with Leasing/licensing/user groups as well as the broader community
- Liaise closely with Council’s internal staff specifically but not limited to the Commercial Business and Strategic Planning & Assets teams on current and future reserve usage
- Review legislation/Council policy applicable to the PoM
- In formulating the PoM ensure that a review of existing Council strategies, plans, Council resolutions, etc are considered and referenced
- Seek Native Title advice for all reserves where required and necessary, and incorporate future works based on Councils/lessee’s long-term plans
- Provide appropriate land descriptions, zonings and mapping
- Detail current and future reserve categorisation, classifications, usage and function
- Conduct public hearing/ consultation process (where required). Note: Where the Crown reserve purpose matches the categorisation of the land under the Local Government Act 1993, Council is not required to hold a public hearing. Where the Crown reserve purpose requires amending then a public hearing will be required.
Kempsey Shire Council (KSC) is the Crown Land Manager for 68 Crown Reserves within the Kempsey Shire that require a PoM – a full list of the reserves is included in Appendix 1 of the attached document. The Crown Land Reserves (CLR) can be grouped into three major themes being Coastal Reserves, Special Reserves and Generic Reserves
