Tender Description

The successful Contractor must:

Develop and offer a professional indemnity insurance product for private midwives recognised as ‘eligible’ by the Nursing and Midwifery Board of Australia (“the NMBA”). The insurance product must be developed to meet the requirements of the Act and associated legislation. A qualifying claim is defined in the Act. The product will also need to include appropriate risk management strategies.

The MPIS product is limited to private ‘eligible’ midwives. An eligible midwife is a registered midwife who meets the additional requirements specified in the Midwife Professional Indemnity (Commonwealth Contribution) Scheme Rules 2010 for additional training and experience, which reflects the NMBA standard for eligible midwives. From 1 January 2017, requirements for recognition as an eligible midwife for the Act will change to reflect changes in the NMBA’s registration standard, and allows a transition period for midwives currently recognised under the current standard, moving to the new standard.  The successful contractor will need to offer a product which covers the two categories of midwives for a period of time to accommodate this transitional period. The two categories will be for the following types of midwives:

* midwives meeting the current NMBA requirements for notation as an eligible midwife on the register of midwives but who have not transitioned to being endorsed to prescribe scheduled medicines (these midwives will need to complete a scheduling medicines course to retain recognition as an eligible midwife under the Act by 1 July 2018); and
* midwives endorsed to prescribe schedule medicines (midwives who meet the new Registration Standard for Endorsement for Scheduled Medicines for Midwives from 1 January 2017)
* Manage claims made and incidents notified during this period and eligible run-off claims after this period;
* Provide de-identified data about midwives accessing the MPIS and the administration of claims to the Commonwealth; and
* Provide an Annual Report to the Commonwealth on the administration of the MPIS.
