Tender Description

⁠⁠⁠Purpose

The Council seeks EOIs to lease the Property subject to the terms and conditions of this REOI.

Council objectives with respect to this EOI are to:

1) To obtain the best value for money outcome for the Property;

2) Enhance amenity of the area for visitors and residents.

3) Obtain an operator with experience, capability, commitment and a sustainable operating model;

4) Obtain a conforming offer in accordance with the terms and conditions of the proposed lease offered.

Proposed Lease

The terms and conditions of the proposed lease are in the document.

The proposed lease includes the following, (and are subject to approval by the Department of Energy, Environment and Climate Action): -

Those terms and conditions prescribed in the standard lease agreement under Section 17D of Crown Land (Reserves) Act 1978 (VIC) (Attachment 1).

Initial term of 2 years, with one further option of 3 years.

3% fixed increases to rent payable to the Council annually.

The lease of the Property will be subject to Council agreeing to the lease under delegated authority and the approval of the responsible Minister.

Background

Ownership

The Property is on Crown Land for which Council is the Committee of Management. It is owned by the Victorian State Government and the premises is a structure owned by Port Phillip Council. Council is custodian of the property on behalf of the Crown. Council is committed to the responsible management of such assets and resources.

This Request for Expressions of Interest has been triggered as the Property has recently become vacant.

Location

The property is positioned within the highly sought-after Elwood Beach and Foreshore precinct, just 8km south of Melbourne CBD. This vibrant coastal destination attracts strong year-round visitation due to its sandy beaches, landscaped open spaces, and extensive recreational amenities: including parks, walking and cycling trails, playgrounds, and BBQ facilities.

Lodgement of Registration

The Registration is to contain the documents, information and details required by this REOI or be sufficient in substance to enable Council (in its sole discretion) to evaluate the Registration in accordance with this REOI. Council may consider a Registration that does not meet these requirements as being non-compliant and reject the Registration.

Expressions of Interest are to be lodged electronically.

All Registrations must be lodged by:

12 midday on Tuesday 31 March 2026 (Closing Time).
