Review and Delivery Of:
1. NSW Local Government Act 1993 Section 64 Development Servicing Plans
2. NSW Environmental Planning and Assessment Act 1979 Section 7.11 and Section 7.12 Development Contribution Plans
Purpose:
The Purpose of the proposed contract is to undertake a review of Development Servicing Plans under Section 64 of the NSW Local Government Act 1993, and Development Contributions Plans under Section 7.11 and 7.12 (formerly Sections 94 and 94A) under the NSW Environmental Planning and Assessment Act 1979. A contributions plan is a public document which sets out a council's policy for the assessment, collection, expenditure and administration of development contributions in a specified development area. The contributions plan identifies the relationship between the expected types of development and the demand for additional public amenities and services created by that development.
In addition Council will be reviewing Section 64 Development Servicing Plans. A Development Servicing Plan is a document that details the water, sewer and stormwater developer charges to be levied on development areas that utilise water, sewer and stormwater infrastructure. These plans are required under Section 64 of the Local Government Act 1993 and cross-referenced in Section 306 of the Water Management Act 2000.
Council's Plans require review in accordance with the 2016 Developer Charges Guidelines for Water Supply, Sewerage and Stormwater issued by the Department of Primary Industries (DPI) Water.
Both Plans will be updated addressing the needs and wants of the relevant stakeholders, strategic direction of Council, the legislative framework and proposed future works.
