Tender Description

⁠⁠⁠Parkes Shire Council (PSC) requests quotations from suitably qualified and experienced organisations for the provision of Legal and Probity Advisory Services associated with Council's ongoing Major Projects progressed by the Project Management Office.

As a minimum, the following scope of services shall be provided:
Council requires legal advice on the conditions of tendering and the development and execution of the Principal Contractor contracts.

Provide Probity advice throughout the delivery of the Principal Works Contracts procurement process to ensure the strict probity and risk management frameworks are adopted and maintained.

Ensure that there are practices in place that mitigate the risk of corruption in tendering and contracting activities including but not limited to having an approved scope of work before going to tender, having an approved budget and approved contract price estimate before receipt of tenders, documented tender evaluation recommendation and approval process in place, a governance structure that establishes independent approval through the procurement process for example the person approving the outcome of the tender process should not be the same person who evaluated the tender responses or was involved in conducting the actual tender process.

Provide Legal Advice during the Contract Works delivery, practical completion, defect liability period and final certificate phases, including but not limited to:
* Security of Payment Act claims.
* Contract EoTs and Variation claims.
* Council Risk Review & Audit Committee updates.
* Contract Notices.
* Regulatory Obligations & Notices.
* Contract Insurance Provisions.

The non- mandatory briefing teleconference will be held on Wednesday 28 March 2018 commencing at 2.00pm AEST teleconference numbers and participants codes that must be used are listed in the RFQ - Section 4.22 Teleconference Details - Non Mandatory Briefing.

Submissions close at 2pm AEST Friday 13 April 2018. At the time of closing only those Quotations received on time will be considered.
