Blackall - Barcaldine Road – Supply of WQ35 Gravel

⁠⁠⁠Supply of WQ35 gravel to Blackall-Tambo Regional Council for the insitu rehabilitation of pavement between Chainage 0.400 and 5.506km on the Blackall – Barcaldine Road. Tenderer to load gravel onto Council trucks on site.

1. The material shall be in accordance with the Department of Main Roads Specification (MRTS07B.1)

2. The material is to be WQ35 gravel. Tenderers to supply recent conforming gravel pit test results with their quotation. Submissions which have no attached conforming test results will not be accepted.

3. The gravel is assumed to have a compaction factor of 1.7. The quantity of gravel required in m3 dense is 2262m3.

4. Gravel will be required in November/December 2017, to be confirmed. Council Works Supervisor or engineer to confirm the supply dates well in advance of works commencing.

5. The lowest or any tender may not necessarily be accepted.

6. The above quantities allow for approximately 5% extra to cover expected losses at site.

7. Suppliers Indemnity: The Supplier (Tenderer) shall indemnify the Purchaser (Blackall-Tambo Regional Council) against:

a) Loss or damage to the purchaser’s property; and
b) Claims in respect of personal injury or death or loss of, or damage to any other property, arising out of or as a consequence of the Supplier’s performance of the Contract, but the indemnity shall be reduced proportionally to the extent that the act or omission of the Purchaser or its consultants, agents or other contractors (not being employed by the Supplier) may have contributed to the injury, death, loss or damage.

This clause shall not apply to:

a. the extent that the Supplier’s liability is limited by another provision of the Contract and

b. exclude any other right of the Purchaser to be indemnified by the Supplier

8. Insurance: The Supplier shall obtain appropriate insurances including but not limited to public liability (minimum $10,000,000.00) workers compensation and insurance of plant and equipment. The Supplier shall provide satisfactory evidence of such insurance if requested by the Purchaser
