Adjudicators registered under the Building and Construction Industry Payments Act 2004 (‘Act’) are required to decide adjudication applications and determine the amount of the progress payment, if any, to be paid by a respondent to the claimant, the date on which any amount becomes payable and the rate of interest payable on any amount.
In the course of deciding an adjudication application an adjudicator is to consider only the provisions of the Act, the provisions of the construction contract from which the application arose, the payment claim to which the application relates, the payment schedule, if any, all submissions that have been properly made, and the results of any inspection carried out by the adjudicator.
In the course of performing their duties under the Act, adjudicators should have consideration to the directions provided by superior courts and tribunals around the country that may impact on how they are to interpret the Act, the contract and any submissions properly made.
The Customer has issued this Invitation to Offer with the objective of receiving and providing registered adjudicators with an annotated service on the Act. The Customer has the following expectations:
* That the annotated service will assist registered adjudicators in performing their duties under the Act; and
* That the annotated service will be kept up to date through regular updates to reflect developments in the interpretation and / or operation of the Act.
