Tender Description
Council (the Principal) is seeking Expressions of Interest (EOI) from appropriately qualified and experienced Contractors for appointment to Council's Code of Conduct Review Panel.
Scope
The panel will support Council's management of complaints made under Council's adopted Code of Conduct and Procedures for the Administration of the Code of Conduct. Successful applicants will be appointed having regard to their skills, experience and demonstrated ability to meet the selection criteria.
Opportunity requirements
1. Mandatory - Minimum Requirements
Does the Contractor:
a) have an understanding and knowledge of an understanding of local government, and
b) have knowledge of Council’s adopted Code of Conduct and Procedures for the Administration of the Code of Conduct;
c) have knowledge of investigative processes including but not limited to procedural fairness requirements and the requirements of the Public Interest Disclosures Act 1994, and
d) have knowledge and experience of one or more of the following:
i) investigations
ii) law
iii) public administration
iv) public sector ethics
v) alternative dispute resolution, and
e) meet the eligibility requirements for membership of a panel of conduct reviewers under the Procedures for the Administration of the Code of Conduct, noting they must not be:
- a councillor;
- a nominee for election as a councillor;
- an administrator;
- an employee of Wingecarribee Shire Council;
- a member of the Commonwealth Parliament, a State Parliament or a Territory Assembly;
- a nominee for election as a member of the Commonwealth Parliament, a State Parliament or a Territory Assembly; or
- a person who has a conviction for an indictable offence that is not an expired conviction.
2. Mandatory - Response Schedules
This Document contains Response Schedules to be completed and submitted as part of the Respondent’s proposal and will be used to evaluate the submission in accordance with the established Mandatory Criteria, Non-cost Weighted Criteria and Cost Weighted Criteria.
3. Mandatory - Public Liability Insurance - minimum $20 million
Insurance against the death or injury to any third party or parties or loss of or damage to any property including loss of use of property whether it is damaged or not whatsoever caused during the course of the contract. The policy shall have a limit of indemnity of not less than the amount indicated for any one occurrence.
4. Mandatory - Professional Indemnity Insurance - minimum $10 million
Insurance against claims made by third party or parties for damages arising from acts, omissions or breaches of professional duty in the course of business through advice and services provided to Council.
5. Mandatory - Workers Compensation Insurance
Workers Compensation/ Personal Accident and Illness Insurance or Personal Income Protection.
Insurance against any death of or injury to persons employed by the Supplier as required by the Workers Compensation Act 1987.
In the event of the Contractor being a Sole Trader or Partnership, the Contractor must provide Council with a copy of either a Personal Accident and Illness Insurance Policy or a Personal Income Protection Policy.
