Tender Description

⁠⁠⁠PART 1 – PREAMBLE 

Burdekin Shire Council invites tenders from suitably qualified tenderers for appointment as a pre-qualified supplier for the supply and delivery of Ready Mixed Concrete as described in more detail in Part 5 Scope.

The initial term of the appointment shall be 2 years (from 1 July 2025), with two options to extend at the Principal’s discretion. Tenderers should note that the Principal may, during the term of the appointment, periodically conduct a new procurement process to ‘refresh’ the register of pre-qualified suppliers, that is, to enable new suppliers to tender and to allow existing pre-qualified suppliers to submit an amended tender if they wish to do so.

Tenderers should note that appointment as a pre-qualified supplier for the supply and delivery of Ready Mixed Concrete entitles the Principal to engage you during the Term without first seeking quotes or tenders but does not give rise to any obligation on the Principal to do so. Appointment as a pre-qualified supplier does not guarantee that you will be engaged to provide any, or any minimum quantity or value of, Goods and Services.

Unless otherwise expressly agreed by the successful Tenderer and the Principal, if and when the Principal engages a successful Tenderer to provide Goods and Services during the Term:

(a) a separate contract will be formed which will comprise the documents identified as forming the contract in clause 4 of the Principal’s standard terms and conditions which is attached to or provided with this request for tender and identified as Part 4 Standard Terms and Conditions – Goods and Services; and

(b) those Goods and Services shall be provided at the prices and rates set out in your tender submission.

If a successful Tenderer’s sums, rates or prices in its tender submission will be increased during the Term, the successful Tenderer will be required to submit revised sums, rates or prices to the Principal for approval by submitting the document using Response Schedule F – Pricing of this RFT to the Principal no later than ten business days before such increase. If the Principal accepts the revised sums, rates or prices, then these shall be fixed until the Principal accepts further revised sums, rates or prices (if any).

On receipt of revised sums, rates or prices, the Principal may request an explanation and/or evidence supporting any price increases and the successful Tenderer shall provide such information promptly after such a request. Where the Principal believes that any increases in the sums, rates or prices are unreasonable then the Principal and the successful Tenderer will meet in good faith to discuss the successful Tenderer’s proposal. Where agreement cannot be reached in respect of sums, rates or prices for particular Goods or Services, the successful Tenderer may retain the original pricing or cease to provide those Goods or Services. The successful Tenderer must notify the Principal in writing of any decrease in the sums, rates or prices as soon as practicable. Any such decrease will have immediate effect.

During the Term successful Tenderers will also be required to maintain, and the Principal may require the successful Tenderers to provide documentary evidence that they have maintained, all insurances, competencies, licences, accreditations, qualifications, permits, clearances and other authorisations which are required to provide the Goods and Services.
