Tender Description

Oberon Council is progressing the debt recovery process for properties with rates and charges outstanding for more than five years.

In accordance with Sections 713–726 of the Local Government Act 1993, Council has resolved to proceed with the Sale of Land for Unpaid Rates and Charges for nine (9) properties where all other reasonable recovery actions have been exhausted.

Council invites Expressions of Interest (EOI) from suitably qualified and experienced real estate agencies and licensed auctioneers to assist in coordinating and conducting the sale process.

SCOPE OF SERVICES

1. Pre-Auction Preparation

• Collaborate with Council staff and Council’s legal representatives (MCW Lawyers) to finalise all sale documentation.

• Coordinate statutory advertising and promotion of the sale in accordance with legislative requirements.

• Prepare the auction strategy, schedule and marketing material.

2. Auction Delivery

• Conduct a public auction for all nine (9) properties, scheduled for February 2026 (date to be confirmed).

• Manage all aspects of auction day operations, including bidder registration, sale conduct and record keeping.

3. Post-Auction Finalisation

• Provide all sale documentation to Council’s appointed conveyancer.

• Assist in completing any post-sale administrative requirements.

Conditions

• Sale costs (including agent and auctioneer fees) will be recovered from sale proceeds where possible.

• Any shortfall will be treated as bad debt or absorbed by Council.

• Council reserves the right not to accept any or all submissions and to negotiate terms with preferred respondents.

SUBMISSION REQUIREMENTS

Interested parties are invited to submit an Expression of Interest including:

• Business name, ABN and contact details.

• Details of relevant experience with government or mortgagee sales, auctions and rural property marketing.

• Proposed fee structure and indicative costs.

• Outline of capacity and approach to delivering the required services.

• Copy of relevant licences and insurances.
