Tender Description

Woollahra Municipal Council (Council) invites tenders from experienced commercial operators to lease, equip, operate and manage the Cooper Park Tennis Centre located at 1 Bunna Place, Bellevue Hill).

The Tennis Centre comprises the Courts, the surrounding and dividing fencing, court lighting, on court cabanas and that part of the building which comprises the Kiosk and storeroom erected on community land at Cooper Park owned by the Council.

All Tenderers must submit a fully complying tender for the lease of 8 tennis courts and kiosk premises, excluding the residence.

The primary use of the Premises is to operate as a tennis centre.

The successful Tenderer will be required to enter into a lease of the Tennis Centre with the Council for seven (7) years (commencing on a date as agreed between the Council and the successful Tenderer) upon the terms and conditions of the attached Lease (including a conditional option to renew the Lease for another seven (7) years) as provided in this Request for Tender (Lease). The Lease and the liability to pay rent at the full rate will commence on the execution of the lease. There will be no rent free period.

The Courts are provided “as is” and tenderers must make their own assessment as to their condition and any works required to meet required standards. Nothing in the RFT detracts from or affects the successful Tenderer’s obligations to ensure that it carries out the works required to meet required standards.

At the commencement of the Lease, the Kiosk will be in a clean painted state with service counters, benchtops, cupboards and 2 underbench refrigerators, water and electricity services and the Kiosk Inclusions, but without any other plant, equipment or furniture. Any changes to the fitout will be the responsibility of the successful tenderer subject to Council approval.

The Council has no responsibility to arrange or facilitate any negotiations between the successful tenderer and the incumbent.

The Court Upgrade Works specified in the Lease are the minimum works required by the Council to be undertaken by the successful Tenderer. The Courts require resurfacing within 24 months.

The Council will welcome and give favorable consideration to any additional innovative proposal in relation to any capital investment into the fitout of the Kiosk and/or the operation and maintenance of the Courts. Details of any additional fitout and associated capital investment of the Kiosk and/or any additional operation and maintenance of the Courts and its surrounds agreed to be undertaken by the successful Tenderer will be inserted in Item 9 of the Reference Schedule of the Lease.

The Council will be responsible for cleaning and maintaining the toilets within the Tennis Centre. The successful Tenderer will be responsible for ensuring that the toilets and the change rooms within the Tennis Centre are open no later than sun rise every morning and closed and securely locked not before sun set every night. The toilets should be closed no later than 10:00PM when the Tennis Centre is closed.

A mandatory pre-tender site meeting will be conducted on 14 February 2024 on site at 10:30am. A maximum of four (4) representatives of each Tenderer may attend the Pre-tender site meeting. Tenderers must register when they attend the site inspection and provide in writing the names of its representatives. The Pre-tender site meeting is conducted for the purpose of providing clarification and queries raised by Tenderers. Tenderers will be issued with a Record of Meeting which will be uploaded to the Portal after the Pre-tender site meeting.

This RFT will close at 3pm 1 March 2024.
