Expressions of Interest - Provision of Artwork

⁠⁠⁠The Lower Eyre Council is currently developing our Reflect Reconciliation Action Plan (RAP) which will formalise our commitment to creating and maintaining respectful and meaningful relations with First Nations peoples within the Lower Eyre Council region.

Council respects and recognises the Native Title Landholders within our region of Naou and Barngarla peoples and also recognises that many First Nations people reside or have grown up within our

communities that do not identify as Naou or Barngarla.

The Lower Eyre Council RAP is being designed to provide consultation opportunities with and for, all First Nations people within the Lower Eyre Council region.

The brief

As part of the development of the RAP, Council is seeking Expressions of Interest from Aboriginal artists to create original artwork that will be used in the final design of our RAP and associated corporate materials.

In addition to the RAP, it is anticipated the artwork (either in full or in part) may be displayed upon Council signage and structures to visually connect the community and visitors to the traditional owners of the land.

Council is seeking up to three (3) unique artworks from local artists.

Submissions

The artists

Successful artists must:

• Identify as Aboriginal or Torres Strait Islander

• Be a resident of the Lower Eyre Peninsula region, or:

• Have a connection to First Nations communities within the Lower Eyre Council region

The artwork

All designs must be authentic and original work of the artist submitting the design. To ensure consistency and allow artwork to be used as a collection by Council, each artwork must be:

• Two-dimensional in form

• Completed on a standard canvas in portrait orientation, 75 x 100 centimeters.

Copyright

The artwork commission includes the grant of an exclusive license to Lower Eyre Council for noncommercial purposes. All finished artwork, that is, the artwork for which the stated fee is paid will be the property of the Lower Eyre Council. As owners of the copyright of the finished artwork, Lower Eyre Council will use the artwork (or part thereof) for any non-commercial, promotional activities as deemed required.

Deliverables:

The finished artwork will be required by 11 September 2023.

Each artist selected will be required to provide the following in the specified timeframe:

• The completed artwork on canvas

• The completed artwork in high-resolution digital format

• A statement/story that describes the artwork and how it represents the vision, and

• A short biography and photo of the artist (and an agreement to publish these materials in/on Lower Eyre platforms).

Fees

The successful artists will be eligible to receive a fee per artwork (to be negotiated), with 25 percent payable to the artist on acceptance of the design by Council, and the balance of 75 percent payable to the artist upon delivery of the final artwork and all associated deliverables.

How to apply

Artists are invited to submit an EOI that addresses the above brief via email to: sacheenh@dclep.sa.gov.au

Applications must include:

• a short statement about yourself, including your full name, your mob, and/or your connection to Country

• your contact details – including your address, contact phone number, and email address

• proof that you reside within the Lower Eyre Peninsula region or have a connection to First Nations communities within the Lower Eyre Peninsula

• Examples of your previous work (photos/imagery) that shows your style

• Overview of your potential concept for the artwork

• Confirmation you can meet our timeline

• Your nominated fee (including GST if applicable) for full copyright and non-commercial use and rights of the artwork

• Please identify and specify any special/cultural conditions or restrictions relating to the artwork or its use. 

Evaluation process

The Lower Eyre Council’s RAP Working group will assess the Expressions of Interest, including whether the applicant meets the eligibility criteria, can meet the required timeframes and any proposed fees.

Should the Working group be unable to make a decision on the successful applicant/s, the Chief Executive

The officer of the Lower Eyre Council will appoint an artist.

The Lower Eyre Council is not obliged to accept any submissions and may elect to move forward without artwork if it is considered that there are no suitable applicants.

The Lower Eyre Council will advise all applicants of the outcomes of the EOI process in writing.

Terms and conditions

1. This project will require each artist to enter into a contractual agreement with the Lower Eyre Council which will set out the approved use of the artworks.

2. The value of the fee/commission to the successful applicants will be outlined (GST exclusive) within the agreed contract.

3. The artists will be formally recognised as the artists of the artworks.

4. The artist can use the artwork for their own personal business activities, specifically:

• promotion of their artistic works and style;

• on their own websites and social media platforms as examples of their work but not as part of their website/logo design.

5. The artists agree that the artwork will not be reproduced, sold, or used by any other entity.

6. The legal title to the artwork (ownership) will rest with Lower Eyre Council.

7. Lower Eyre Council will have the right in perpetuity to use and reproduce the artwork and/or a portion of the artwork in its promotional activities and materials.

8. No further or ongoing payment will be made by Council to the artist other than the commission fee payment.

9. The artist on the signing of any document is accepting the Terms and Conditions of the commissioning and future use of the artwork by the Lower Eyre Council.
