Tender Description

Woollahra Municipal Council invites tenders from suitably qualified parties to lease, equip, operate and manage the business of a licensed restaurant and function centre in Dunbar House located at 9 Marine Parade, Watsons Bay. Dunbar House is erected on community land at Watsons Bay owned by the Council.

The successful tenderer will be required to enter into a lease of the Premises with the Council for five (5) years (commencing on a date as agreed between the Council and the successful tenderer) upon the terms and conditions of the attached Lease (including an option to renew the Lease for another five (5) years).

The Premises has:

(a) water, gas and electricity services;

(b) a coolroom installed in the basement; and

(c) a coolroom installed in the kitchen area;

The Premises will be leased unfurnished and "as is". Tenderers must make their own assessment as to their condition and any work required to meet required standards. Nothing in the RFT detracts from or affects the successful Tenderer’s obligations to ensure that it carries out the works required to meet required standards.

Subject to the Conditions of Tender, the Council will welcome and give favourable consideration to any innovative proposal in relation to upgrading and refurbishment works. Details of any fit out and associated capital investment of the Kitchen Area and/or Premises agreed to be undertaken by the successful Tenderer will be inserted in the Lease.

Tenders containing alterations or erasures and where information is not clearly and legibly stated may be excluded from consideration. Any alteration made to a tender must be initialed by the tenderer.

Pursuant to the Retail Leases Act 1994 (NSW) the draft disclosure statement is included within this RFT. The disclosure statement includes important information about the premises, the lease and the lessee’s financial obligations.

Following the selection of the preferred tenderer, Council will complete relevant details and provide to the successful Tenderer the Lessor and Lessee Disclosure Statements in accordance with the Retail Leases Act 1994 (NSW).

The preferred tenderer will be required to sign the disclosure statement prior entering the Lease. Failure to sign the disclosure statement may lead to the tender being declined.

A mandatory Pre-tender site meeting will be conducted on site at Dunbar House 11 am Wednesday 5 July 2023.
