Tender Description

This Request for Information (RFI) seeks to understand the interest and capabilities available in the market, to help develop and shape the Review of the Separation Regime in Model Operating Requirement 5.6.

The Australian Registrar’s National Economic Conveyancing Council (ARNECC) recently completed a review of the cyber security requirements currently imposed on Electronic Lodgment Network Operators (ELNOs) and Subscribers under the Model Operating Requirements (MOR) and the Model Participation Rules (MPR), to ensure cyber security requirements continue to represent best practice for mitigating against cyber fraud within the boundaries of the Registrars’ power under the National Electronic Conveyancing Law (ECNL).

ARNECC is now seeking a Request for Information from external, independent consultants for the next stage, which is the review (Review) of the separation regime in Version 6.1 of the Model Operating Requirements (MOR), Operating Requirement (OR) 5.6 (the separation regime) and report to ARNECC.

The policy intent behind the separation regime is to prevent ELNOs from gaining an unfair commercial advantage through improperly or unfairly using their position in the market, and information obtained as a result of performing their functions as an ELNO, to prevent or limit competition. OR 5.6 contains ‘ring-fencing’ provisions.

Landgate is acting on behalf of ARNECC as the sponsor of the RFI and Review.
