Sale Conditions
1. Background
1.1 The Council is offering for Sale by Tender one (1) Mazda with conversion for manual wheelchair access by rear ramp (“Vehicle”).
1.2 The Vehicle is offered for sale in ‘as-is, where-is’ condition with no warranty given, expressed or implied.
1.3 The Vehicle is in working order and fit for purpose.
1.4 This tender assessment is weighted in the following priority order:
1.4.1 not for profit organisations with a registered address within The Barossa Council boundaries who provide services to people living with disability.
1.4.2 not for profit organisations with a registered address within The Barossa Council boundaries providing services to aged people or individuals with a registered address within The Barossa Council.
1.5 All tenders will be assessed on agreed assessment weighting including but not limited to 1.4.1 and 1.4.2
2. Tenderer to Inform Itself:
2.1 Each Tenderer is deemed to have, prior to submitting its tender, become acquainted with the goods offered by the council, and made all necessary examinations, investigations and inspections required.
2.2 The Vehicle may be inspected by prior arrangement with the Community Transport Team by calling on Phone: (08) 8563-8411 or emailing transport@barossa.sa.gov.au
The location of the Vehicle is 43-51 Tanunda Road, Nuriootpa (The Barossa Council Office) carpark.
3. Tender to Purchase
3.1 The Council seeks a Tender for the sale of one (1) Mazda with conversion for manual wheelchair access by rear ramp.
3.2 All prices are to be lump sum and fixed. Tendered prices must include GST. A reserve price of $3,500 inclusive of GST has been set on the Vehicle.

3.3 The successful Tenderer will be responsible for the payment of any duties, taxes and charges associated with the lodgement of vehicle transfer with Services SA
3.4 Tenders must be submitted on the Formal Offer Form that you can find on the website
3.5 The Former Offer Form must be completed in full and send via email to: tenders@barossa.sa.gov.au
3.6 Once the Closing Date is passed the tenders will be assessed and the successful Tenderer will be notified no later than Wednesday 23 March 2022 the Notification Date.
3.7 If Tenderers have any problem submitting their Tender or have any questions, they must contact the Nominated Contact Person – Jo Parker jparker@barossa.sa.gov.au 8563 8411 prior to the Closing Date allowing reasonable time for the Nominated Contact Person to respond.
3.8 A tender is deemed to have been lodged by the Tenderer when the tender has been received by the Council’s server.
4. Payment and Handover
4.1 The successful Tenderer will be responsible for the payment of any duties, taxes and charges associated with the lodgement of vehicle transfer with Services SA.
Tenders must be submitted on the attached Formal Offer Form.
The Formal Offer Form must be completed in full and sent via email to tenders@barossa.sa.gov.au no later than the Closing Date - 3.00 pm (Adelaide Time) on Wednesday 9 March 2022.
Once the Closing Date is passed the tenders will be assessed and the successful Tenderer will be notified no later than Wednesday 23 March 2022 the Notification Date.
If Tenderers have any problem submitting their Tender or have any questions, they must contact the Nominated Contact Person – Jo Parker jparker@barossa.sa.gov.au 8563 8411 prior to the Closing Date allowing reasonable time for the Nominated Contact Person to
respond.
A tender is deemed to have been lodged by the Tenderer when the tender has been received by the Council’s server.
4. Payment and Handover
4.1 The successful Tenderer is required to make full payment within ten (10) working days of the Notification Date.
4.2 Payment shall be in the form of a bank cheque made out to the Barossa Council, or by direct transfer to the nominated Council bank account prior to handover of the vehicle.
4.3 The successful Tenderer must sign the transfer notices and take delivery of the Vehicle within ten (10) working days of being notified that their tender has been successful.
4.4 Failure to make payment or to collect the item in accordance with these requirements may be taken to be a withdrawal of the Tenderer’s bid.
5. Acknowledgement by Tenderers
Tenderers acknowledge that the Council;
5.1 Makes no representations and offers no undertakings in issuing this request for tenders.
5.2 Accepts no responsibility for a tenderer misunderstanding or failing to respond correctly to this Sale by Tender.
5.3 Will not be liable for or pay any expenses or losses incurred by any party whether in the submission of a tender or due to an outcome of the tender process.
5.4 Will not be bound by any verbal advice given or information furnished by any member,
officer or agent of the council in respect to the tender.

Council’s Rights
The Council reserves the right to:
6.1 Amend, vary, supplement or terminate this Sale by Tender at any time.
6.2 Accept or reject any tender, including the highest tender.
6.3 Negotiate with any tenderer regarding their tender.
6.4 Discontinue negotiations with any tenderer.
