Respondents to this registration are required to be genuine public transport operators who are currently operating or have an interest in operating ferry services in the Greater Sydney region.

The purpose of this Market Sounding is to encourage competition, maximise value for money and ensure market and contract sustainability. The market sounding process will be conducted in a manner that ensures:

• Our market sounding processes and any content we provide will be consistent from Respondent to Respondent;
• The market sounding process will not detail the tender process, but will rather seek feedback and information from the market in relation to the operation of ferry services; and
• The process is in full compliance with NSW Government and TfNSW procurement policies.

The process is intended to assist TfNSW to assess the best delivery model and contracting strategy for the services. The market sounding process is not part of any tender process and is not a request for a proposal to deliver services of any kind.

Registrants are invited to participate in the market sounding but there is no obligation to participate and non-participation will not affect consideration of a later tender submission by any Registrant or non-Registrant. Similarly, feedback given during this market sounding will not in any way bind the Registrant to provide a tender response or to include in a tender response anything discussed as part of the market sounding process.

Information provided or discussed during market sounding will not in any way be taken into account or impact any future tender evaluation or contract award decision.

The Registrants to the market sounding acknowledge and agree that TfNSW will not be liable for any costs or expenses incurred as a result of its participation in this market sounding exercise.
