This is a simple tender for the disposal of goods.

That is, the Shire of Wiluna is offering the goods for sale, and by submitting a tender you will be making an offer to buy the goods at the price you tender.

Subsection 2.58 (2) of the Local Government Act 1995 provides that a local government can dispose of property to the person who, at a public tender called by the local government makes what is, in the opinion of the local government, the most acceptable tender, whether or not it is the highest tender.

Accordingly, the highest (or any) tender will not necessarily be accepted.

The following conditions shall apply to the sale of goods which are the subject of this request for tenders:

• (a) The goods are offered "as is, where is". No warranties are given as to the condition of the goods and it is the responsibility of tenderers to satisfy themselves as to the condition of the goods.
• (b) The goods are not warranted to be fit for any particular purpose.
• (c) Neither ownership nor possession of the goods will transfer to the Successful Tenderer until the tendered purchase price has been paid to the Shire.
• (d) Payment can be made by cash, bank transfer or credit card. The Shire of Wiluna will not accept cheques.
• (e) Once ownership of the goods transfers to the Successful Tenderer, the new owner must promptly remove the goods.
